Former Brazilian President Jair Bolsonaro has been placed under house arrest by order of the country’s Supreme Court, deepening the legal and political crisis surrounding the right-wing leader. The decision, issued by Justice Alexandre de Moraes, comes amid allegations that Bolsonaro violated court-imposed restrictions while under investigation for plotting to overturn the 2022 election results.
Justice de Moraes, who is overseeing the high-profile probe, cited Bolsonaro’s repeated defiance of previous orders, including a ban on political communication and the use of third-party social media. A recent incident in which Bolsonaro addressed supporters via a phone call amplified by his son, Senator Flávio Bolsonaro, at a rally in Rio de Janeiro, was seen as a direct violation.
“The flagrant disregard for the preventative measures was so obvious that — it bears repeating — the defendant’s own son deleted the incriminating video from Instagram in an effort to hide the transgression,” wrote de Moraes in the ruling.
In addition to house arrest, Bolsonaro is now prohibited from receiving visits other than from lawyers or individuals authorized by the Supreme Court. He is also barred from using a mobile phone, directly or through intermediaries.
Bolsonaro’s legal team has rejected the accusations, denying that he breached any judicial orders and announcing plans to appeal the ruling.
In a striking diplomatic turn, the U.S. State Department issued a statement condemning the Brazilian court’s decision. “We condemn the court order and will hold accountable all those aiding and abetting sanctioned conduct,” the statement read.
The comment reflects growing tensions between Brasília and Washington, fueled in part by Bolsonaro’s close ties to former U.S. President Donald Trump. Trump, who has called the charges against Bolsonaro a “witch-hunt,” recently invoked the case as justification for imposing 50% tariffs on Brazilian goods — despite a U.S. trade surplus with the country.
Justice de Moraes, who is also under U.S. sanctions, accused Bolsonaro of leveraging his political network — including his sons — to incite unrest and call for foreign interference in Brazil’s judiciary.
Despite the mounting legal pressure, Bolsonaro remains defiant and retains a devoted base of supporters. On Sunday, pro-Bolsonaro demonstrations took place across multiple cities in Brazil, with calls for judicial reform and denunciations of the ongoing investigation.
The case marks a significant moment in Brazil’s efforts to assert judicial accountability against high-ranking officials accused of threatening democratic institutions. “Justice is blind, but it is not foolish,” de Moraes wrote. “The court will not be made a fool of by someone who believes political or economic power places them above the law.”
